1. Who can use our Services

Some individuals may voluntarily choose to share their Followers Content with Thempo so that it may be used for communications, commerce, and marketing purposes. This is particularly the case for billboards, other advertisements, the Apple App Store, the Google Play Store.
If you are interested in this approach, you must give Thempo permission to use your Followers(Friends)-Reserved Content. Globally Shared Content means Content that you have shared with everyone on Thempo. In exchange for our Services, you grant us a worldwide, non-exclusive, copyright-free, sublicensable license to use, copy, reproduce, process, adapt, edit, publish, transmit, display and distribute the content you share as Content shared globally on all media and by all distribution methods.
This permission allows us to share your globally shared Content with the rest of the world and allow others to do the same. You acknowledge that this authorization includes the right for Thempo to provide, promote and improve our Services and to make Shared Content available globally to other companies, organizations or individuals for the purposes of syndication, broadcast, distribution, promotion or publication on other media and services. These additional uses by Thempo, or by other companies, organizations or individuals, are conducted without any compensation for the globally shared Content as your use of our Services is considered sufficient compensation.
4. Report non-compliant content
We are not required to review Content that users share through our Services. However, we are committed to making our Services a space where people can have fun and express their true selves in complete safety. Any content that does not respect the rights of others, or that does not comply with laws, rules, and regulations or the User Agreement (“Non-Compliant Content”) is prohibited. If you notice non-compliant Content, you can report it to us via the application's reporting tools or via the form on our website. If you believe that your Content has been copied in a way that infringes your intellectual property rights, you can report it directly in the application or via the intellectual property reporting form on our website.
5. Terminate our Services
We may temporarily or permanently suspend your account and prevent you from using our services if we judge that you have shared non-compliant Content or that you have used our Services in a way that infringes the rights of others, or which does not does not comply with any laws, rules, regulations or the User Agreement.In general, we apply a 3-level sanction policy. This means that if you share non-compliant Content, we will suspend your account for 30 days, during which time you will not be able to post Content or view other Content on our Services. If this happens 3 times, it's out! We will permanently suspend your account from our Services and prevent you from creating a new Thempo account.
Please note, certain non-compliant Content (for example, Content relating to child sexual abuse (CSAM)) will result in your immediate and permanent suspension from our Services.You can contest this suspension by contacting us via our support form .To protect you, other users and our Services, we may temporarily suspend your account in case we detect abnormal activity that could pose technical or security risks to you, other users or our Services. We will delete your account after 2 years of inactivity. Before we get to that point, we will contact you so that you can stop the deletion if you wish.We are aware that the sauce does not take every time. So know that you can delete your account at any time by accessing your account settings and choosing the delete account option.
6. Authorization to use our Services
Our Services are protected by copyright, trademark, trade secret and other laws around the world. As tempting as it may be, nothing in the User Agreement gives you the right to use the Thempo name or any other trademark, logo, domain name, other distinctive brand feature or other proprietary right of Thempo . During the period of use of our Services, Thempo grants you a personal, worldwide, copyright-free, non-transferable and non-exclusive authorization to use the software provided to you as part of our Services . The sole purpose of this authorization is to enable you to use and benefit from our Services in accordance with the User Agreement. This permission expires when you stop using our Services.Thempo reserves the right to use any feedback, comments or suggestions that you may provide regarding our Services.
7. Limitation of liability
By using our Services, you agree that the liability of Thempo, its affiliates, related companies, agents, officers, employees, representatives, partners and licensors, is limited to the fullest extent permitted in your country of residence.
8. Applicable law and competent jurisdiction
To the extent that these Terms permit you and Thempo to bring legal action in a court, you and Thempo agree to the exclusive jurisdiction of any courts & tribunals of RD Congo (Republic Democratic of Congo) and Congolese law. You and Thempo agree that any claim and dispute (whether contractual or not), arising from or relating to the Terms or the User Agreement will be brought exclusively before the courts of RD Congo, and that such disputes will be governed by Congolese law.
Thempo may update the User Agreement at any time. If the update affects the rights and obligations of either party, we will notify you approximately 30 days before the update becomes effective. If you continue to use our Services after 30 days, this will mean that you accept the updated User Agreement. If you do not wish to accept it, you must stop using our Services. If any part of these Terms or the User Agreement is found to be unenforceable, our lawyers will surely struggle, but all other provisions will still apply. The User Agreement is concluded between you and Thempo.
